Welcome to PetNest SA. These Terms and Conditions govern your use of www.petnestsa.co.za
and any purchase from us. By accessing our website or placing an order, you agree to these
Terms in full. These Terms comply with the Consumer Protection Act 68 of 2008 (CPA) and
the Electronic Communications and Transactions Act 25 of 2002 (ECT Act).

PetNest SA is an online retail store based in South Africa, specialising in pet grooming
tools and accessories for dogs and cats.

2. Acceptance of Terms
By using our website or placing an order, you confirm that:
• You are at least 18 years of age, or have the consent of a parent or legal guardian
• You have read, understood, and agree to these Terms
• You agree to our Privacy Policy, Shipping Policy, and Refund Policy, which form
part of these Terms
3. Products and Descriptions
We make every effort to describe and display products accurately. However:
• Product images are for illustrative purposes. Colours may vary due to screen settings
or manufacturing differences.
• Descriptions are provided in good faith based on supplier information.
• We reserve the right to update descriptions and images without prior notice.
All product information is provided in plain language in accordance with Section 22 of the CPA.
4. Pricing
All prices are in South African Rand (ZAR) and include VAT where applicable. Prices are
correct at the time of publishing but may change without notice. The price applicable to
your order is the price displayed at the time of purchase.
In the event of a pricing error, we will notify you and give you the option to proceed at
the correct price or cancel your order for a full refund.
5. Placing an Order
Placing an order constitutes an offer to purchase at the displayed price. Your order is
only accepted once it has been dispatched and you receive a shipping confirmation.
PetNest SA reserves the right to:
• Decline or cancel any order at our discretion
• Limit the quantity of items purchased per customer
• Cancel orders where items are out of stock, with a full refund issued
6. Payment
Payment must be made in full at checkout via the methods available on our website. By
providing payment details, you confirm you are authorised to use the payment method and
that all information provided is accurate and complete.
PetNest SA does not store full payment card details. All payment information is processed
securely by our certified payment gateway provider.
7. Delivery
Delivery terms are governed by our Shipping Policy. Standard delivery is 7–14 business
days from dispatch. Risk of loss and ownership of goods passes to the buyer upon delivery.
8. Consumer Rights – Consumer Protection Act
Your statutory rights under the CPA are not limited or waived by these Terms. In particular:
• Section 54: You have the right to receive quality service.
• Section 55: Products must be of good quality, in good working order, and free of defects.
• Section 56: All goods carry a 6-month implied warranty against defects from delivery.
• Section 60: You have the right to fair and honest dealing.
9. Returns and Exchanges
All sales are final except as required by the CPA. Our exchange and returns process is
set out in our Refund Policy. PetNest SA does not issue cash refunds except where legally
required and where an exchange is not possible due to stock unavailability. Nothing in
these Terms limits your rights under the CPA regarding defective goods.
10. Limitation of Liability
To the fullest extent permitted by South African law, PetNest SA shall not be liable for
any indirect, incidental, special, or consequential damages arising from:
• The use or inability to use our products or website
• Delivery delays caused by couriers or circumstances beyond our control
• Errors or omissions in product descriptions
Our total liability to you for any claim shall not exceed the purchase price of the
product giving rise to the claim. This limitation does not apply where prohibited by
the CPA or other applicable legislation.
11. Intellectual Property
All content on our website — including logos, images, text, graphics, and product
descriptions — is the intellectual property of PetNest SA or its licensors. You may not
copy, reproduce, distribute, or use any content without our prior written consent.
12. Prohibited Use
When using our website, you agree not to:
• Engage in fraudulent, abusive, or unlawful conduct
• Attempt to gain unauthorised access to our systems or data
• Use our website in a way that could damage, disable, or impair its functionality
• Transmit harmful, offensive, defamatory, or unlawful content
PetNest SA reserves the right to restrict or terminate access to any user who violates
these conditions.
13. Privacy
Our Privacy Policy explains how we collect, use, and protect your personal information
in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA).
14. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall
be subject to the exclusive jurisdiction of the South African courts.
15. Complaints and Dispute Resolution
If you have a complaint, contact us first at petnestsa@gmail.com. We will endeavour to
resolve all complaints fairly and promptly. If we are unable to resolve your complaint,
you may refer the matter to:

16. Changes to These Terms
PetNest SA reserves the right to update these Terms at any time. Updated Terms will be
posted on this page with a revised date. Continued use of our website after any changes
constitutes acceptance of the updated Terms.
